Rent Recovery

A large, household name Insurance Company client instructed us on a Tuesday morning to recover approximately £15,000 in unpaid rent from an independent retailer.

The retailer was a German company, and our client had reason to believe that the UK operation was being wound down with a view to an imminent withdrawal from the UK market.

We attended at the demised premises on the Wednesday morning. Our instructions were clear, the rent was to be produced - either in cash or banker's draft - failing which goods and stock to the value of the outstanding rent was to be seized.

Initially, the tenant denied the rent was in arrears but eventually conceded that it was. We explained our instructions - full payment or goods would be removed. The tenant quickly checked with their solicitors as to the legal position. They confirmed that the Landlord was perfectly within his rights. An hour later we left with a banker's draft for the full amount, which was credited to our client the following day.

Comment

The fact was our client knew the tenant had the money and was simply not paying. How could it be recovered fast before the tenant disappeared? Answer – The Bailiff.

A lengthy attempt to recover the rent through the Courts would have found the tenant back in Düsseldorf.
